This document sets out the terms and conditions between beatvyne Limited and you when you purchase a ticket or register for any event or conference organised by beatvyne Limited or participate in any survey of beatvyne Limited’s including, but not exclusively, under the brand name beatvyne’s Music x Tech Experience (also “MxT”, hereinafter referred to as the “Event”).

In addition to these terms and conditions, when accessing or using Products and/or Services on this Site that are offered by beatvyne Limited, you will be subject to any agreements or licenses applicable to beatvyne’s general Terms of Service. If you do not wish to be bound by these Terms, please do not register, attend or participate in the Event.

By purchasing a ticket or registering for an event or conference organised by beatvyne Limited or participating in a survey you are agreeing to comply with and be bound by these terms and conditions and beatvyne’s Terms of Service.

You should read this document carefully.

 

Changes to this policy

beatvyne Limited reserves the right to modify this Data Protection Policy and Declaration of Consent at any time. Any changes will be posted to this website and other places we deem appropriate so that you are aware of the changes.

1 DEFINITONS

Applicable Laws – all relevant laws, statutes, rules, regulations, guidelines, directives and codes;

beatvyne – means the Company, beatvyne Limited.

beatvyne’s Music x Tech Experience – a gathering of the world’s leading experts, from the established to the radical, highlighting new technologies in a changing global entertainment industry, with a focus on the fan experience organised by beatvyne Limited.

beatvyne Platform – means a digital application called beatvyne.

beatvyne Service – means the beatvyne Platform, the beatvyne Site (www.beatvyne.com etc.) and other additional locations as mentioned at beatvyne.com, as well as beatvyne Events, including, but not exclusively, under the brand name beatvyne’s Music x Tech Experience.

Experience Hub – means the exhibition area at beatvyne’s Music x Tech Experience

Hub – means the exhibit space in the Experience Hub

User –  a person who accesses and/or uses the beatvyne Service whether a registered Member of the beatvyne Platform or not.

2 DESCRIPTION OF THE BEATVYNE SERVICE

2.1 beatvyne  Limited (hereinafter referred to as “beatvyne”), a company incorporated under the laws of Ireland with company registration number 558318, whose registered office is at 27 Clontarf Bay, Dollymount Park, Dublin 3, Ireland, organises Events including, but not exclusively, under the brand name beatvyne’s Music x Tech Experience, a gathering of the world’s leading experts, from the established to the radical, highlighting new technologies in a changing global entertainment industry, with a focus on the fan experience, encouraging interdisciplinary and cross-cultural collaborations to jointly enhance the music/entertainment industry for the better.

2.2 beatvyne owns and operates the website https://www.beatvyne.com, a live music marketplace (the “beatvyne Platform”) that connects Fans with Artists in unique music spaces, and related websites and mobile applications (the “Site”), including all information, documents, text, audio, visual, and graphics (excluding Third Party Content, which is defined below) on the Site (collectively, the “beatvyne Content”) as well as all software, products, and services offered and/or operated by beatvyne and/or third parties through the Site (collectively, the “Products and/or Services”). The beatvyne Platform provides the ability for Hosts to book Artists and Service Providers, to set up gigs between themselves and sell tickets to Fans, and is used as a registration and networking system for beatvyne’s Music x Tech Experience,  available for your use subject to the terms and conditions set forth in this document.

3 GENERAL TERMS FOR ALL DELEGATES

3.1 Admittance to Event

beatvyne, at its sole discretion, reserves the right to refuse admission to any Event or Conference for any behaviour, which it deems unacceptable, or for breach of the terms and conditions.

 

3.1.1 Wristbands and Lanyards

For security and identification reasons, please have at all times:

  1. your official Event wristband on your wrist;
  2. your official Event lanyard including your badge around your neck; and
  3. carry photo identification and display it on request.

 

3.1.2 Account Registration and Badge Scanning

If you choose to complete an Event profile by creating a beatvyne Account on the beatvyne Platform, Site, Application, Products and/or Services, your profile will be discoverable and visible in the Application to other Event delegates. By using badge scanning you agree to beatvyne’s Terms of Service and our Privacy Policy.

 

3.2 Photography, Audio and Video Recording

Any unauthorised use of photographic, audio, video and other recording equipment at Events and Conferences is prohibited.

By attending the Event you acknowledge and agree that the Event (or any part of it) may be photographed or recorded by us or our partners. You agree to permit us, or any third party licensed by us, to use, distribute, broadcast, or otherwise globally disseminate your likeness, name, voice and words in perpetuity in television, radio, film, newspapers, magazines and other media now available and hereafter developed, both before, during and any time after the Event, and in any form, without any further approval from you or any payment to you. This grant includes, but is not limited to, the right to edit the media, the right to use the media (alone or together with other information), and the right to allow others to use or distribute the media.

 

3.3 Changes or Cancellation of an Event

Please note that while speakers and topics are confirmed at the time of publishing, circumstances beyond the control of the organisers may necessitate substitutions, alterations or cancellations of the speakers and/or topics. As such, beatvyne reserves the right to alter or modify the advertised speakers and/or topics if necessary without any liability to you whatsoever. Any substitutions or alterations will be updated on the Site as soon as possible.

In the unlikely event of cancellation of a conference or event, the liability of beatvyne is limited to the share of paid registration fees that remains after credit card and payment processing fees have been incurred and deducted.

 

3.4 Force Majeure

beatvyne is not responsible for any loss or damage as a result of a substitution, alteration, cancellation or postponement of an Event. beatvyne shall assume no liability whatsoever in the circumstances that an event is cancelled, rescheduled or postponed due to a fortuitous event, Act of God, unforeseen occurrence or any other event that renders performance of an event impracticable, illegal or impossible. For purposes of this clause, a fortuitous event shall include, but not be limited to: war, fire, labour strike, extreme weather or other emergency.

 

3.5 Refund and Cancellation

Your ticket remains the property of beatvyne and is a personal revocable license, which may be withdrawn, and admission refused at any time upon a refund of the printed registration price.

All purchases of tickets for an Event (including hotel rooms if applicable) are non-refundable in their entirety.

If an individual seeks a refund on general attendee tickets that were purchased before their startup ticket was purchased, beatvyne will not grant a full refund when the general attendee ticket price has increased beyond the startup ticket price.

If you have secured a complimentary ticket but have already bought a ticket, you are not eligible for a refund.

beatvyne will not be responsible for any tickets that are lost or stolen.

 

3.6 No Reselling

The tickets purchased (including hotel rooms if applicable) are for your own personal use or that of your business only and may not be resold under any circumstances, including but not limited to use as part of any promotion or competition. Where there has been any resale or attempted resale of any tickets (or any other breach of this term), we reserve the right to cancel the relevant tickets with immediate effect.

You cannot resell a ticket. Doing so will void the ticket and the ticket holder will not gain entry into the event.

We reserve the right to cancel any ticket purchase made by any person or body whom we reasonably believe to be associated with any ticket broker or tout.

 

3.7 Visa Requirements

beatvyne will not be liable for the granting of any visas that are required to attend any Event or Conference. Please allow sufficient time for the visa application procedure.

In the event that an attendee’s visa is not granted tickets will not be refunded for any event or conference.

 

3.8 Intellectual Property Rights

Please refer and adhere to section 5 of beatvyne’s general Terms of Service in addition to this paragraph.

 

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in and to the Event, all materials and/or content contained within the Site, Application, Products and/or Services shall remain at all times owned by beatvyne or our licensors.

You are permitted to use this material only as expressly authorised by us.

We reserve all rights not expressly granted in and to the Site, Application, Products and/or Services and the content on the Site, Application, Products and/or Services.

 

It is strictly forbidden for any company, organisation or attendee to attempt to host or organise any event in conjunction with, contiguous to or purporting to be related to beatvyne’s Music x Tech Experience or its affiliates without the express prior permission and cooperation of beatvyne. In the event of a breach of these terms any tickets purchased will be rendered null and void. beatvyne reserves their right to take such legal action including a claim for damages as may be appropriate.

 

3.9 Warranties

Please refer and adhere to section 13 of beatvyne’s general Terms of Service.

 

3.10 Limination of Liability

Please refer and adhere to section 17 of beatvyne’s general Terms of Service in addition to this paragraph.

 

You acknowledge and agree that views expressed by speakers at or in connection with an Event are their own and that beatvyne does not accept any responsibility or liability for any advice given or views expressed during or in connection with an Event.

Materials shared or distributed at or in connection with an Event are intended for information purposes only and should not be relied upon by you or others. We and our related companies do not provide any guarantees, conditions or warranties that the materials are complete or accurate and do not accept any responsibility or liability for reliance by you or any person on any aspect of the Event and/or any information provided at the Event.

 

Whilst we will use reasonable endeavours to verify the accuracy of any information we place on the Site, Application, Products and/or Services, we make no warranties, whether express or implied in relation to its accuracy.

 

3.11 Indemnity

Please refer and adhere to section 19 in beatvyne’s general Terms of Service in addition to this paragraph.

 

You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of the terms by you or any other liabilities incurred by us arising out of your use of the website, or use by any other person accessing the Site, Application, Products and/or Services using your PC or internet access account.

 

3.12 Applicable laws and Jurisdiction

Please refer and adhere to section 21 of beatvyne’s general Terms of Service in addition to this paragraph.

Irish law governs these terms and conditions and any dispute is subject to the exclusive jurisdiction of the Irish Courts.

 

3.13 General

beatvyne shall be entitled to delegate the duties provision of its obligations under this Agreement.

These terms (including beatvyne’s Terms of Service and our Privacy Policy) contain the entire agreement and understanding between us in respect of all matters which are referred to herein and supersede any prior, written or oral agreement between us relating to such matters. You confirm that in agreeing to accept these terms you have not relied on any representation that is not expressly included herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become a part of these terms. However, nothing in these terms purport to exclude liability for any fraudulent statement or act.

If any part of the terms herein shall be deemed unlawful, void or for any reason unenforceable then that provision shall be deemed to be severable from these terms and shall not affect the validity and enforceability of any of the remaining provisions of the terms.

3.13.1 Declaration of Consent

I hereby give my consent for beatvyne to collect, process and use my personal data for the purposes of processing the purchase of my ticket and for any other use to which I have consented, including the importation of contact information for which I have provided my explicit prior consent.

This information will be used for the purposes of processing ticket sales, sharing marketing information regarding the event to our attendees and for the purpose of compiling delegate lists which may be published on our Site, Application or Products and/or Services, and circulated by email to our email database, which includes all past and current delegates. If you do not wish your name, photograph, country where based and company name to appear on the delegate list please email [email protected]

 

3.13.2 Purchasing Tickets

I hereby give my consent for the mandatory and voluntary data collected from me in the course of purchasing and or registering for tickets sold by beatvyne. I further give my permission for my user account details to be stored. I acknowledge that I may provide beatvyne a reasonable timeframe to remove my details at any time that I no longer wish them to be stored. I acknowledge and accept that my data will be used for commercial purposes in accordance with this Data Protection Policy and Declaration of Consent and will be retained and stored for this purpose. Should you wish your data to be removed you must request beatvyne to do so in writing. Requests will be processed within a 30-day period.

3.13.3 Online Surveys

I hereby give my consent for beatvyne to store any voluntary information I may provide in the course of participating in an online survey. I acknowledge and accept that my data will be used for commercial purposes in accordance with this Data Protection Policy and Declaration of Consent and will be retained and stored for this purpose.

 

3.13.4 Ticket Registration

I hereby give my consent for beatvyne to use for the purposes of processing complimentary or otherwise ticket registration the mandatory data and any voluntary data I provide when registering a complimentary admission ticket. I further give my consent for the voluntary data provided. I acknowledge and accept that my data will be used for commercial purposes in accordance with this Data Protection Policy and Declaration of Consent and will be retained and stored for this purpose.

3.13.5 Use of Personal Data for Advertising Purposes

beatvyne will not share your address, e-mail address, credit card information or personal information to any third party without your permission. I hereby give my consent for beatvyne Limited to store the following types of data as a profile for internal purposes:

  • Mandatory and voluntary data collected when purchasing tickets.
  • Mandatory and voluntary data collected when registering a complimentary admission ticket as well as the date of the ticket registration.
  • Voluntary disclosures when participating in online surveys.
  • If I have opted-in to receive email communication about related events I give consent for beatvyne or subsidiary companies to analyse and use the data for the purpose of targeted advertising communications to me on relevant topics and products in connection with beatvyne or subsidiary events and promotions.
  • Data collected from any connected social media for which I have provided my explicit prior consent.
  • If I have provided my mobile telephone number I consent to beatvyne or subsidiary companies to contact me by text message in relation to events for which I am purchasing a ticket or registering an expression of interest.
  • I acknowledge that my data may be used for marketing purposes by beatvyne to contact me by phone or e-mail to ascertain my views on our services, which will be similar to the ones to which I have already subscribed.
  • I furthermore consent to the mathematical and statistical analysis of my personal data for advertising purposes (scoring).
  • I also give my consent for my data to be updated and supplemented with additional data.
  • beatvyne has free lifetime use of any image or video content created by attendees at beatvyne’s Music x Tech Experience (and any other events organised by beatvyne).

a.  Personal information

When personal information (e.g. name, email address, work address, phone numbers and other contact information) is provided through the Site, Application or Products and/or Services, or directly to us by email you give consent to beatvyne for:

        • Processing and administering your personal data to perform all necessary actions to give effect to your request or instructions
        • Retaining a record of incoming and outgoing communications (e.g. email) to process your personal data as outlined in this Privacy Statement.

beatvyne may also collect the following information about you:

  • Information that you provide by filling in forms on our Site.
  • Name and physical shipping, contact and payment addresses.
  • Email address and telephone numbers
  • Date of birth
  • Tax identification or VAT number (if applicable)

b.  If you contact us we may keep a record of that correspondence.

Information we receive from credit reference and fraud detection agencies or other third parties we may use to verify your information. We may ask you to complete surveys for research purposes, although you do not have to respond to them.

c.  Right of Access

You have a right to be given a copy of any of your personal data held by beatvyne in accordance with section 4 of the Data Protection Acts subject to certain exceptions. Requests for a copy of your personal data can be emailed to [email protected].

d.  Right of rectification or erasure

If beatvyne holds incorrect information about you which was originally submitted by you through this website, you have the right to have the data amended. Further, you have the right to have any information you have sent to us via this website erased. To request your right to rectification and/or erasure please send your request to [email protected].

Requests should include:

  • Your name and address.
  • A description of the specific personal data you wish rectified.

Please note that beatvyne is not required to rectify or erase your data where doing so would prevent you from meeting your contractual obligations to beatvyne or where beatvyne is required to process (including retaining) your personal data for a lawful purpose in accordance with the Data Protection Acts. In the event of any conflict between these terms and the provisions of the Data Protection Acts, the Data Protection Acts shall prevail.

e.  Security

The security of your Personal Information is important to us. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, beatvyne cannot guarantee its absolute security and cannot accept any liability where the security of your Personal Information is compromised. The security of your personal information is important to us.

4 ATTENDEE TERMS

4.1 Tickets and Pricing

You will find details of attendee ticket pricing and fees for the Event here. Ticket prices for the Event are correct at the time of publication.

We reserve the right to change the ticket prices at any time but any changes will not affect tickets that have already been purchased.

A valid ticket entitles you to entry to the Event as an Attendee. beatvyne will not provide transport or travel expenses to or from any Event or Conference, unless expressly agreed in writing.

In certain cases, free or subsidised tickets may be offered within 30 days of the Conference start date. In these instances, tickets must be assigned within 7 days of receipt of your ticket in accordance with the details provided in the above paragraph.

 

4.2 Delivery

Once a successful purchase transaction has been completed, tickets are delivered in electronic soft-copy via email to the email address nominated by the purchaser. For some ticket types it may be necessary to complete required information – such as attendee name or email address – before the tickets can be issued.

The ticket acts as a receipt for the transaction and can be used to redeem entry at the Event listed on the ticket. A printed hard-copy ticket or an electronic soft-copy ticket detailing the reference number can be used to register at the Event.

All tickets must be assigned to an Attendee, and all Attendee details must be 100% complete within 30 days of receipt of your ticket. For the avoidance of doubt, this includes name, job title and company name. Ticket reassignment after this date is prohibited.

 

4.3 Discounts

We may from time to time offer certain discounted tickets to encourage attendance at the Event. We are not obligated to offer any discounts and reserve the right to change or withdraw a discount offer at any time at our sole discretion.

 

4.4 Ticket name changes

Name changes will be facilitated free of charge at our sole discretion. No name changes will be facilitated 7 days prior to the commencement of the event and the ticket price will be forfeited.

5 VOLUNTEER TERMS

5.1 Selection

By applying and agreeing to act as a volunteer at the Event, I acknowledge that:

  • I will receive no compensation for travel, accommodation etc., unless otherwise agreed in writing.
  • There is no guarantee that I will be selected to be a volunteer at the Event and the selection is at beatvyne’s sole discretion.
  • If I violate any event rule or fail to show up for an assigned shift, my accreditation can be removed and I will be denied access to the event.
  • I attest to the truth of all statements made in my application.
  • The use of alcohol and/or controlled substances before or while on duty is strictly prohibited. Violation of this policy will result in immediate dismissal, removal of accreditation and removal from the Event grounds.
  • I acknowledge that I may be photographed or recorded in accordance with the section “Photography, Audio and Video Recording”.
  • In the course of the event, I may be dealing with confidential information and I agree to keep such information in the strictest of confidence and abide by the rules governing its use as provided for in the Privacy Policy.
  • I have read and fully understood these terms and conditions.

 

5.2 Ticket Refund

If you have been selected to be a Volunteer at a Conference but have already bought a ticket, you are not eligible for a refund or reimbursement under any circumstances.

6 EXHIBITOR TERMS

6.1 Exhibitors

We offer space at the Event to Exhibitors who wish to occupy a location at the Event and operate a stall where they can exhibit certain goods or services to delegates (a “Hub”) at agreed times, subject to these Terms.

 

The Exhibitor is only permitted to conduct business from its allotted Space and shall not canvass, promote, advertise or solicit for business in any other area of the Venue without our express prior written consent.

 

The Exhibitor is prohibited from sub-letting the Space without our express prior written consent. If and to the extent that the Exhibitor is permitted to sublet the Space, the Exhibitor shall remain responsible for the Space and shall be liable for any breach of these terms by any party to whom the Space is sublet.

 

The Exhibitor shall not canvass, promote, advertise or solicit for business on behalf of unrelated Third Parties without our express prior written consent.

 

The Exhibitor’s operation of the Hub at the Event shall be carried out in full compliance with these Terms.

 

6.2 Location of Exhibits

beatvyne retains the right in our absolute discretion to relocate the Experience Hubs and/or require the Exhibitor to occupy an alternative Hub within the specified site at the Event where we deem it to be necessary in the best interests of the Event or as may be required on security, health & safety grounds or otherwise.

 

6.3 Standard of upkeep

The Exhibitor must keep and maintain the interior, exterior, the fittings and equipment installed at the Hubs in clean, orderly, sanitary and good repair.

 

6.4 Waste

The Exhibitor is responsible for the disposal of all waste products and rubbish and for taking off-site all rubbish generated by it. If required, the Exhibitor shall provide litter bins for the use at the Event which the Exhibitor must remove from the site at the end of each day. The Exhibitor is also responsible for the periodic clean-up of tables and floors in their Hub area and the surrounding area.

 

6.5 Access

We permit the Exhibitor to operate their Hub between the hours as communicated from time to time. The Exhibitor must ensure, to the complete satisfaction of us, that all Hubs and rubbish are completely dismantled and removed off-site each day of the Event. The Exhibitor is not entitled to permit anyone, other than its personnel or those having business with the Exhibitor, to have access to the Experience Hub.

 

6.6 Security Instructions

The Exhibitor must observe and comply with, and ensure that its staff engaged at the Hubs observe and comply with all instructions and directions given by or on behalf of beatvyne or venue management, and with beatvyne’s and venue management’s rules and regulations as communicated from time to time. The Exhibitor must not damage or allow its employees to damage the site that is hosting the Event or the Hub or any part thereof. All Exhibitor personnel on site must wear identification badges at all times and must not enter any restricted areas.

 

6.7 Provided equipment by beatvyne

All equipment (screens, laptops, cabling and other electronic equipment, rooms, furniture etc.) supplied by beatvyne at the Event are on a rental basis and no exchange, transfer or refund of ordered items on-site will be permitted.

 

Any complaint regarding rented items or installation must be lodged by emailing [email protected] before the opening of the Event.

In respect of items rented on the day, items should be inspected immediately and tested to ensure they work. Otherwise, all items are deemed to be received in good order and condition.

 

Exhibitors must pay for all damages or losses to equipment supplied to them. The equipment must be insured by the Exhibitor, who will remain liable until our authorised staff have collected the equipment. In case of non-return, the Exhibitor will be required to reimburse beatvyne for the full cost of the equipment at the original insurance value.

 

Cancelled orders are not refundable. Non-standard items may be offered on request, subject to a separate quotation, and are subject to the same terms.

 

Nothing in these Terms creates or deems to create the relationship of landlord and tenant between beatvyne and the Exhibitor nor should these Terms be construed as creating a transfer of a property interest to the Exhibitor nor any greater interest in the Event in favour of the Exhibitor.

 

6.8 Exhibitor Insurance

Each Exhibitor must effect and maintain with an insurer of repute the level of insurance as set out in the Event Partnership and Exhibition Agreement, and upon request shall produce to beatvyne evidence of the current policy of such insurances and receipts for the premiums payable thereof.

Failure to make provision of such evidence to our satisfaction of will permit to immediately terminate these Terms and your right to Exhibit at the Event.
